Families of Philadelphia crash victims may seek damages
A Philadelphia man is expected to face criminal charges related to a car crash in the Northeast Philadelphia, Pennsylvania, area that resulted in the deaths of two people. The driver struck the victims' car, causing it to lurch onto a sidewalk and then catch fire. The victims were pronounced dead at the scene of the crash.
While the state may seek criminal charges against the driver, this will not compensate the victims' families for their losses. However, under principles of negligence law, the families of the crash victims may be able to file personal injury lawsuits in civil court against the driver. If a court determines that the driver was indeed negligent, and that this negligence caused the injuries at issue, the families would be entitled to collect damages for the wrongful deaths of their loved ones. These damages could include monetary recovery for vehicle damage, medical costs, burial costs, pain and suffering, emotional distress, loss of wages and loss of companionship.
DUI appears to be cause of Philadelphia car accident
A head-on collision that occurred last week in the Spring Garden section of Philadelphia has resulted in DUI charges for one of the drivers.
Three people were injured in the accident, including two female occupants in one vehicle who had to be freed from the car they were trapped in. Reports indicate that rescuers had to use the Jaws of Life to remove one of the women from the wreckage.
Dog owners can be sued for premises liability
Property owners have a legal duty to keep their property reasonably safe for visitors especially if they have pets that exhibit aggressive behavior. If a property owner creates a dangerous situation on their property, and as a result, someone is injured on their property, then that person could recover damages through a premises liability lawsuit.
A lawsuit was filed last week out of state against the owners of two dogs and the Humane Society that was involved in the adoption of the dogs. The complaint alleges that the Humane Society ignored recommendations by veterinarians and animal behaviorists that certain dogs at the shelter should not be adopted because of aggressive tendencies.
Woman files suit for injuries sustained during cesarean section
It's amazing to think before we had prenatal care and hospital births, that women used to give birth at home, with no special equipment for mother and baby. You would think that in today's world mothers should be comforted by the technology that is available, but for one woman, her cesarean-section went horribly wrong when her abdomen started on fire when her doctor had made the incision for her cesarean section. Because of the injury she sustained, she is filing a medical malpractice suit against the doctor and the hospital.
The incident occurred in March 2010 during her cesarean-section delivery. During the procedure, the woman said that she smelled smoke and her mother, who was beside her daughter during the delivery; saw a flame shooting up from her daughter's left side. The doctor saw the flame and patted it and put it out. He told the patient there was nothing to worry about and that there had been a small fire.

Pedestrian-car accident results in injury and arrest
Being involved in a car accident can be scary, but being involved in a hit and run accident can be scary and frustrating. Luckily, a man who hit a pedestrian, decided to turn himself into authorities, giving the victim and his family a sense of peace.
The accident happened earlier this week in Pennsylvania when a man hit a pedestrian at an intersection and then fled the scene. A witness who observed the accident had the wherewithal to follow the man and obtained his license plate number and the make of his car. She called police and they broadcasted his tag number and located the car within a half hour of the accident. Police found the car, which had severe hood and windshield damage.

Imagine going to the doctor complaining of one ailment but ending up in a coma and partially paralyzed. That's what happened to this one-time successful property manager when she sought relief from the migraine headaches she had suffered her entire life.
Pennsylvania residents might be interested in a recent medical malpractice lawsuit that ended in the jury awarding the victim $22 million in total damages for her injuries. The case began in 2006 when, in trying to determine the cause of her migraine headaches, doctors decided to perform a test on her called a cerebral angiogram.

Accident fatalities down on Pennsylvania roads
A new report just released, states that the number of people killed in car accidents has decreased on Pennsylvania roads, but fatal accidents involving 16-year-old drivers has increased. While the overall study was positive for the state, parents of young drivers may want to review road safety with their teens to hopefully prevent teen car accidents.
PennDOT conducted the study on road safety and this is what they reported:
- There were 1,291 people killed on Pennsylvania roads in 2011, 33 fewer than 2010 and the second lowest number on record.
- In Delaware County there were 20 driving related fatalities in 2011, 23 in 2010, 20 in 2009, 21 in 2008 and 22 in 2007.
- Drunk driver accidents decreased from 417 to 379.
- Motorcycle accidents fell from 223 to 198.
City to offer free spay and neuter program
The free spay and neuter program in Pittsburgh, Pennsylvania, has been reinstated for city residents. This is great news for animal lovers and for the city of Pittsburgh, which on average euthanizes approximately 20,000 homeless pets every year.
Besides reducing the pet population, this program will:
- Reduce the number of roaming animals.
- It will decrease the number of animal bites.
- Not as many animals will be euthanized.
- A reduction in costs to residents who have their property destroyed by roaming animals.
- Improve the health of the animals from tumors and infections.
