Third party liability

Something that the state of New Jersey does do right is that it allows drunk driving victims to recover from multiple parties in some cases of drunk driving accidents. When liability is opened up to third parties who are at least partially responsible for the accident, there are more recovery options available for the plaintiff.

  • Dram shop laws – New Jersey dram shop laws provide that a seller of alcohol may be liable for selling alcohol to a visibly intoxicated patron or to a person who is under 21 when that person subsequently gets into a DUI accident causing injuries to an innocent accident victim.
  • Social host laws – New Jersey law provides that a social host may be liable in some situations where alcohol is served to a visibly intoxicated guest in a reckless manner with no regard for the harm to life or property that could result. If that intoxicated guest then gets behind the wheel and causes an accident, the innocent injured parties may name the social host as a defendant.
